Terms & Conditions
Last updated: September 30, 2026
These Terms and Conditions outline the rules for using the Unique Branding Solutions website, engaging UBS branding, marketing, and growth-system services, and participating in the UBS SMS messaging program. Please read them carefully before submitting a request.
1. Introduction
These Terms and Conditions ("Terms") govern your use of the website operated by Unique Branding Solutions ("UBS"), a sole proprietorship operated by STEVEN FOREST DBA UNIQUE BRANDING SOLUTIONS, and any inquiry, request, or engagement for UBS services. By accessing this website or contacting UBS, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use this website or submit information to UBS.
2. UBS Services
UBS provides branding, website design, content and social-media management, advertising, customer-acquisition campaigns, CRM setup, and marketing-automation services. The specific scope, deliverables, timeline, and pricing of any engagement are defined in a separate written agreement or proposal between you and UBS.
Any descriptions of services, plans, or potential inclusions on this website are general in nature and do not constitute a binding offer. Final recommendations are based on your business, goals, market, and required level of support.
3. Use of This Website
You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use of, any other party. You must not misuse the website by introducing viruses, attempting unauthorized access, scraping content, or interfering with its normal operation.
Content on this website, including text, graphics, logos, and layout, is owned by or licensed to UBS and may not be reproduced without prior written permission from UBS.
4. Inquiries and Strategy-Call Requests
When you submit a form or request a strategy call, you authorize UBS to use the information you provide to contact you, evaluate your needs, and prepare recommendations. Submitting a request does not create a service agreement or any obligation to engage UBS services.
You are responsible for providing accurate and truthful information. UBS is not liable for issues arising from incomplete or incorrect information submitted through UBS forms.
5. SMS Terms of Service
STEVEN FOREST DBA UNIQUE BRANDING SOLUTIONS provides an SMS messaging service to prospective and existing clients who opt in through the optional, unchecked SMS consent box on our website contact or booking form. By opting in, you can expect to receive non-marketing, customer-care messages, including inquiry responses, requested quote follow-ups, consultation confirmations and reminders, rescheduling notices, and project updates.
By opting in to receive SMS messages from STEVEN FOREST DBA UNIQUE BRANDING SOLUTIONS, you agree to the following terms:
You can cancel the SMS service at any time. Just text "STOP" to the number you received the message from. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at [support email address or toll-free number to be added].
Carriers are not liable for delayed or undelivered messages.
As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
If you have any questions regarding privacy, please read our privacy policy.
We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications.
6. Service Engagements
Any paid engagement is governed by a separate agreement that outlines deliverables, fees, payment terms, timelines, and responsibilities. In the event of a conflict between these Terms and a signed service agreement, the service agreement controls with respect to that engagement.
Timelines and results are estimates based on the information available at the time. Marketing and advertising outcomes are influenced by many factors outside UBS's control, and UBS does not guarantee specific results.
7. Client Responsibilities
To help UBS deliver effective services, clients agree to provide timely access to information, brand assets, accounts, and approvals as reasonably required. Delays in providing materials or feedback may affect timelines and outcomes.
Clients are responsible for the accuracy of any content they approve and for ensuring they have the right to use any materials they provide to UBS.
8. Fees and Payment
Fees, payment schedules, and refund terms for any engagement are specified in the applicable service agreement. Unless otherwise stated, invoices are due according to the terms outlined in that agreement.
UBS reserves the right to pause or adjust services if payment terms are not met.
9. Intellectual Property
Upon full payment of applicable fees, final deliverables created for a client are transferred to the extent agreed in the service agreement. UBS retains the right to display completed work for portfolio and marketing purposes unless otherwise agreed in writing.
Pre-existing materials, templates, tools, and methodologies developed by UBS remain the property of UBS, and UBS grants a limited license to use them as part of the delivered work.
10. Third-Party Platforms and Services
Some services involve third-party platforms for advertising, websites, CRM, scheduling, or automation. UBS is not responsible for the availability, performance, or policy changes of those platforms, and clients remain responsible for any fees, terms, or accounts associated with them.
11. Disclaimer of Warranties
This website and UBS services are provided on an "as is" basis. To the fullest extent permitted by law, UBS makes no warranties, express or implied, regarding the website or any particular outcome from UBS services. Results vary based on the offer, market, budget, service area, sales process, and other business factors, and past results do not guarantee future performance.
12. Limitation of Liability
To the fullest extent permitted by law, UBS shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or UBS services. UBS's total liability for any claim is limited to the amount you have paid UBS for the specific service giving rise to the claim.
13. Indemnification
You agree to indemnify and hold UBS harmless from claims, damages, or expenses arising from your use of the website, your submission of information, or any materials or content you provide to UBS for use in UBS services.
14. Changes to These Terms
UBS may update these Terms from time to time. Updated versions will be posted on this page with a revised "last updated" date. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the applicable laws of the jurisdiction in which UBS operates, without regard to conflict-of-law principles. Any disputes will be handled in the courts of that jurisdiction unless otherwise agreed.
16. Contacting UBS
If you have questions about these Terms, you may reach out through the contact options listed on the website. Until dedicated contact details are published, please use the strategy-call request form to get in touch with the UBS team.
